Objectives The students define correctly the function and structure of the Belgian authorities and the judiciary. They define correctly the notion "decentralization" and define correctly the position of the decentralized authorities (in relation to the other authorities). The students define correctly the notion "legal personality". They define correctly the legal framework of a non-profit organisation. They indicate precisely the organisation and function of the provinces, the municipalities and the social offices. The students define correctly the legal position of the official compared to the legal position of the employee. They define correctly the legal protection against the authorities (the right of access to public documents, the legal obligation to state the reasons for a decision, the ombudsmen, the administrative appeal procedures, the Council of State). They define correctly the legal position of foreigners. The students have the capacity to understand legal instruments.
Topics 1. survey of the most important legal norms (constitution, legislative acts, ...) and judicial review
2. the notion 'legal personality'
3. fundamental characteristics of the Belgian public services (centralization, decentralization, provinces, municipalities, supervisery competence, ...)
4. structure and competences of the social offices (ocmw)
5. legal position of the official compared to the legal position of the employee
6. legal protection against the authorities:
a. the right of access to public documents
b. the legal obligation to state the reasons for decisions
c. the ombudsmen
d. the administrative appeal procedures
