Objectives
Section: Civil Liability:
  • Obtaining insight in civil liability
  • Being able to distinguish the various types of liability and gaining insight in the concurrence and coexistence of them
  • Get acquainted with and learn to apply the elements of the fault version
  • Gaining insight in the causality between fault and damage, getting acquainted with the theory of equivalence and being able to apply it in concrete cases
  • Gaining insight in the different sorts of compound liability
  • Get acquainted with the concepts damage and the various sorts of damage
  • Get acquainted with the various methods of capitalization and being able to use them in order to determine the compensation in concrete cases
Section: Social Legislation:

Section: Civil Liability:
The study of civil liability consists of four parts:
  • Part 1: types of liability: objective, fault-, civil, contractual, extra-contactual, criminal liability, concurrence and coexistence of different types of liability
  • Part 2: simple liability: unlawful act, accountability, circumstances beyond one's control, acceptance of risks, conditions of indemnification, causality, science of equivalence.
  • Part 3: compound liability: different types of compound liability, liable individuals, object of their liability and nature of the presumption
  • Part 4: damage and compensation: different sorts of damage, compensation of the damage, methods of capitalisation
Section: Social Legislation:
Collective industrial relations
The employment contract:
  • Experimental stipulation
  • Suspension of the performing of the employment contract
  • Ending of the employment contract
  • Temporary labour
  • Employment contract for part-time labour
Legislation of labour
Social security: general organisation and overview of the various branches.

Final judgement:
  • Section 1 Civil Liability: 50% of the total mark
  • Section 2 Social Legislation: 50% of the total mark
Civil Liability:
  • First exam session: 100% written exam
  • Second exam session: 100% written exam
Social Legislation
  • First exam session: 100% oral exam
  • Second exam session: 100% oral exam
Students only enrolled for taking the exams:
  • First and second exam session: ditto regular students
Students who have not passed in the first exam session, but got a score of at least 10 on 20 for one of the parts, are not obliged to redo this part in the second exam session of the same year. They, however, have to take the exam on the parts where they had less than 10 on 20, if they do not do this they are listed as being absent for the whole course.
