Objectives
This course offers the foundation for the study of environmental law in the second and third year.
Special attention is paid to environmental policy and the usefulness of the environmental law in it.
There is also a lot of attention paid to the general control on the divided sections.
The sectorial legislation will not be discussed yet.

Section 1: Introduction to the environmental law and environmental policy
  • You gain insight in the structure of the environmental legislation
  • You can situate the environmental law in the whole of the environmental policy and in the whole of the Belgian impartial law.
  • You can denote the interference between environmental law and administrative law.
  • You can denote which instruments are useful for handling an environmental policy. You also have insight in the way in which they are useful for reaching results.
  • You have insight in the methodology and the repertory of concepts related to environmental law.
  • You know which public bodies are involved in the environmental policy in Flanders.
  • You have insight in the structure of the environmental policy plans as well as in the municipal agreement of the environmental policy.
  • You are capable of representing a brief overview of the European environmental regulation.
  • You are environment-minded.
  • You understand the social relevance of the environmental issues.
  • You are critical towards the current environmental policy (both regional as European).
  • You read professional literature (concerning the discussed subjects) and are capable of understanding them.
Section 2: Inspection of the divided organizations
  • You learn to search for information in the environmental code.
  • You learn to search which licenses are necessary for a certain activity that burdens the environment. You also learn to search which obligations have to be fulfilled in order to be able to hand in an application for a license.

Section 1:Discussed in following (linear) order:
  • Location of the environmental law in the Belgian impartial law as well as in the environmental policy.
  • National and international sources of law of the environmental law.
  • Relation between environmental law and the administrative law.
  • Instruments needed to lead an environmental policy.
  • Administrative organisation of the environmental policy in Flanders.
  • Enactment consisting of the general stipulations of the environmental policy.
  • The municipal environmental agreement.
  • Overview of the financial instruments of the environmental policy.
  • Overview of the European environmental law.Numerous articles coming from the professional environmental policy literature (international and national) are analysed and commented upon in class.
Section 2: Are discussed (thematically):
  • General inspection on the divided organisations (enactment of environmental licenses, Vlarem 1 and Vlarem 2 and the enactment of company-internal environmental protection)
  • The environmental conditions for the non-divided organisations in Vlarem 2.


Prerequisites
There are no general prerequisites required.
The student is expected to care about environmental issues.

The lecturer is always available for individual questions (before or after the lessons).

Teaching Methods
Section 1:
Lectures and limited use of method of question-and-answer (concerning articles of environment coming from the professional literature)

Section 2:
Mainly lectures with exercises in class.

Assessment
  • First exam session: written exam 90% and continuous assessment 10%
  • Second exam session: written exam 100%
  • Students only enrolled for taking the exams:
    first and second exam session: written exam 100%
